
Terms of sale

1. Seller
Alima Hadifi, sole trader, trading as Esprit Singulier. SIRET: 75028098400022. Address: 296 rue de la Croix Rouge, 59200 Tourcoing, France. Contact: contact@espritsingulier.com.
2. External Memory
External Memory is a web application of notes organized in folders, usable on phones and computers. Notes are stored on the user's device. It is an organization tool, without medical advice, and it does not replace medical care.
3. Price and payment
€10 as a one-time payment, without a subscription. The final amount is shown before payment. Payment is processed by Stripe; Esprit Singulier neither sees nor stores your banking details.
VAT not applicable, art. 293 B of the French General Tax Code (CGI).
4. Immediate access and compatibility
Access is provided after payment, to the email address used for the purchase: on first opening, a login code is sent to that address. The application is accessible from the received link; its icon can be added to the phone home screen. Access is personal.
Updates required to maintain conformity are owed during the continuous supply period of the service, i.e. the 12 months of access and any renewed periods. No separate commercial maintenance period beyond this supply is announced. Feature evolutions are not a contractual promise. In case of a compatibility or access problem, contact the seller before purchase.
5. Request for immediate access and withdrawal
The consumer in principle has 14 days from the conclusion of the contract to withdraw. You can write to contact@espritsingulier.com or send the form below to the seller's address.
Before payment, the following unchecked box lets you request immediate access: "I request immediate access to the digital content and acknowledge that, once performance begins immediately, I waive my right of withdrawal."
The loss of the right of withdrawal for digital content without a tangible medium is limited to the conditions of article L.221-28, 13° of the French Consumer Code: prior express agreement, acknowledgement of the loss of the right, and confirmation on a durable medium. This notice does not generally remove the rights applicable to the interactive digital service (notes application), nor statutory guarantees. Where an exception does not apply, the right of withdrawal remains.

6. Refunds and guarantees
No refund restriction deprives the buyer of their legal rights. In case of a defect or access problem, write to contact@espritsingulier.com to request assistance and, where the legal conditions are met, repair of conformity, a price reduction or termination of the contract.
7. Statutory guarantees
Alima Hadifi is liable for the statutory guarantees applicable to digital content and services. Bringing into conformity is free of charge, without unjustified delay and without major inconvenience to the consumer. Updates necessary to maintain conformity must be provided during the applicable legal or contractual period. A price reduction or termination of the contract may be requested in the cases provided by law.
Statutory guarantee - continuous supply of the digital service
The consumer is entitled to the statutory guarantee of conformity in case a lack of conformity appears within 12 months, and any agreed renewal periods, from the supply of the digital content or digital service. During this period, the consumer only needs to establish the existence of the lack of conformity, not the date it appeared. The statutory guarantee of conformity requires providing all updates necessary to maintain the conformity of the digital content or service during 12 months and any agreed renewal periods. It entitles the consumer to have the digital content or service brought into conformity without unjustified delay after the request, free of charge and without major inconvenience.
The consumer may obtain a price reduction while keeping the digital content or service, or may end the contract with a full refund against renouncing the digital content or service, if 1° the trader refuses to bring the digital content or service into conformity 2° conformity is delayed unjustifiably 3° conformity cannot occur without costs imposed on the consumer 4° conformity causes a major inconvenience to the consumer 5° the non-conformity persists despite the trader's unsuccessful attempt.
The consumer is also entitled to a price reduction or termination of the contract where the lack of conformity is so serious that it justifies an immediate reduction or termination.
The consumer is then not required to request conformity beforehand. Where the lack of conformity is minor, the consumer is entitled to cancel the contract only if the contract does not provide for payment of a price. Any period of unavailability of the digital content or service for bringing it back into conformity suspends the remaining guarantee until the content or service is again conform. These rights result from articles L. 224-25-1 to L. 224-25-31 of the French Consumer Code. A trader who in bad faith obstructs the implementation of the statutory guarantee of conformity incurs a civil fine of up to 300,000 euros, which may be raised to 10% of average annual turnover (article L. 242-18-1 of the Consumer Code).
The consumer also benefits from the statutory guarantee against hidden defects under articles 1641 to 1649 of the French Civil Code, for two years from the discovery of the defect. This guarantee entitles to a price reduction if the digital content or service is kept, or to a full refund against renouncing the digital content or service.
8. Personal data
The email address is used to provide access and information related to the purchase. See the privacy policy for the processing carried out in the application.
9. Complaints and mediation
For any complaint: contact@espritsingulier.com or the seller's postal address. The consumer has the right to free recourse to a consumer mediator after a prior written complaint that remained unresolved.
At the date of this version, no approved mediator has been appointed for Esprit Singulier. The contact details of the competent mediator therefore cannot be provided. This absence does not remove the consumer's rights and must be regularized by the seller; customer service does not replace an independent mediator.
10. Applicable law
French law, without prejudice to the mandatory protections enjoyed by the consumer. Recourse to mediation does not prevent the exercise of rights in court.
